Introductory description
The aim of this half module is to introduce the main principles and policies of Competition Law in the United Kingdom (UK) and European Union (EU).
Module aims
The aim of this half module is to introduce the main principles and policies of Competition Law in the United Kingdom (UK) and European Union (EU). Specific topics will be studied within the general themes of the legal framework, institutions, the economic theory underlying the law, and approaches to the regulation of specific anticompetitive conduct in the two main areas of: Abuse of market power (dominance): Article 102 TFEU (EU) and Chap II Competition Act 1998 (UK) and anti-competitive agreements: Article 101 TFEU (EU) and Chap I (UK). Remedies and enforcement. No prior knowledge will be assumed.

By the end of the module, students should be able to:
- identify and understand the relevant law and economics underlying EU and UK competition law
- critically evaluate the effectiveness of the law and identify any weaknesses
- critically evaluate the law in the context of policy debates underlying the interpretation and direction of EU and UK competition law
- understand the relationship between EU and UK competition law and the implications of Brexit
- apply the law to practical problems

The portfolio assessment will be submitted as one complete piece of work comprising two parts for no more than 3000 words. Part I will assess students technical knowledge of the legal rules by, for example, providing advice on a factual scenario. Part II the students must prepare an essay which requires a critique of a particular aspect of the law and policy of EU and UK competition law. The word count will be divided equally between the two parts. Each part must be no more than 1,500 words and will account for 50% of the total grade for the portfolio The portfolio will assess both the technical understanding and application of the law and a critical understanding of its policy context. |
Feedback on assessment
Written individual and generic feedback will be provided on each part of the portfolio. The final mark will be a summation of the marks for each part of the portfolio.
